The Brattleboro Selectboard will be holding their July moments of public participation for anyone wishing to provide feedback and comments on the EMS plan.
They will also approve new land use regulations, and hear a report on plans for improvements to Living Memorial Park. You can sometimes bring up other items not on the agenda during public participation, if the Chair allows.

The Brattleboro Selectboard will hold a special meeting on Tuesday, July 25, 2023 at 6:15pm Selectboard Meeting Room at the Brattleboro Municipal Center (230 Main Street). Prior to the special meeting, at 5:15pm, the Board will convene and is expected to immediately enter into executive session to discussion contracts, real estate and the evaluation of a public employee. Invited into the executive session are the Town Manager and the Assistant Town Manager. No action will be taken in executive session. The public may also participate in the meeting over Zoom. The attached agenda contains information on how to access the meeting remotely, including the required “passcode.” ASL interpreters will be available for deaf and hard-of-hearing community members.

7. CONSENT AGENDA (6:40 PM)
A. Sunset Lake Road Culvert Bid Award
In a memorandum dated July 18, 2023 Public Works Director Dan Tyler discusses the Sunset Lake Road Culvert Replacement Project and its bid process. Though it is the higher bid, DPW requests that the Board award the bid to Bellco Excavating LLC, as the other bidder’s proposed use of metal wing walls does not meet the specifications for the request and Bellco proposed closing the road for a shorter duration. Therefore, DPW requests that the Board award the Sunset Lake Road Culvert Bid to Bellco Excavating LLC for a total of $106,600. A VTrans Structures Grant of $72,000 is in place for this project and the balance would be funded through the Capital Roads Improvement line item. By approving the consent agenda, the Board will award the Sunset Lake Road Culvert Replacement contract to Bellco Excavating of Brattleboro, VT for a total of $106,600.

8. UNFINISHED BUSINESS (6:45 PM)
A. Land Use Regulations – Second Reading and Possible Adoption
In a memorandum dated July 14, 2023 Planning Director Sue Fillion discusses the background information, Bylaw Adoption Process, and an overview of the proposed amendments to the Town Land Use Regulations. The Board is asked to conduct a second reading and possibly adopt the Land Use and Development Regulations. A link to the Land Use Regulations can be found in the backup materials. Several memos dated July 17, 2023 and July 18, 2023 addressing potential additional amendments are also included in the backup materials.
POTENTIAL MOTION: TO ADOPT THE AMENDMENTS TO THE BRATTLEBORO LAND USE AND DEVELOPMENT REGULATIONS AS PRESENTED IN THE JUNE 5, 2023 DRAFT AND TO INCLUDE THE AMENDMENTS FOR ADMINISTRATIVE REVIEW OF MINOR SUBDIVISIONS AND CONFORMANCE WITH ACT 47 AS DETAILED IN THE JULY 17 AND JULY 18 MEMOS.
9. NEW BUSINESS (7:00 PM)
A. Windham Southeast Supervisory Union Board Appointment – Joint Meeting
In a memorandum dated July 21, 2023 Town Manager John Potter explains that the Windham Southeast Supervisory Union (WSESU) has asked the Selectboard for a consultation regarding filling a WSESU Board vacancy. This consultation is a requirement under Vermont State Statute. There is one application for one vacancy, and it can be found in the Board’s backup materials.

B. Heart Rose Club Outside Consumption Permit (7:10 pm)
In a memorandum dated July 25, 2023, Town Clerk Hilary Francis discusses the Heart Rose Club’s application for an Outside Consumption Permit for the 30’X10’ deck with a railing connected to the building and a 40’x20’ area down steps that would be fenced in. At the June 6 Selectboard meeting the Heart Rose Club received a First Class Liquor License and an Annual Entertainment Permit and at the July 11, 2023 Selectboard meeting they were approved for a Third Class Liquor License. There are no outstanding taxes or fees owed to the Town. Ms. Cheney will be present at the Selectboard meeting to address any questions the Board or the public might have.
POTENTIAL MOTION: TO APPROVE AN OUTSIDE CONSUMPTION PERMIT FOR THE HEART ROSE CLUB FOR THE DECK CONNECTED TO THE BUILDING, LOCATED AT 11 GREEN STREET.
B. EMS Update (7:20 PM)

In a memorandum dated July 21, 2023, Town Manager John Potter discusses the background information regarding this item as well as aspects of public engagement, and aspects of a fully municipal EMS operating model, including costs. Potter also gives an overview of the two responses from the Town’s Request for Information (RFI) from potential third-party EMS contractors as well as aspects of a draft Request for Proposals (RFP) that staff have prepared based on feedback from the RFI. Staff asks that the Selectboard review the materials and consider the presentation along with input from the public.

D. Living Memorial Park Generational Improvements Project Update (8:30 PM)
In a memorandum dated July 14, 2023, Recreation and Parks Director Carol Lolatte provides an update on the Generational Improvements to Living Memorial Park. She discusses improvements to the skating rink, the new maintenance building, the softball field lights, and the Kiwanis parking lot.
