Brattleboro Selectboard Agenda and Notes – October 11, 2022

The Brattleboro Selectboard will purchase almost $24,000 worth of 9mm pistols at their next regular meeting.

The board will also discuss a domestic violence resolution, extend a loan to Metalarts, begin modification of the Code of Ordinances regarding bicycles,  and more. You can bring up other items not on the agenda during public participation.

The Brattleboro Selectboard will meet on Tuesday, October 11, 2022 at 6:15pm in the Selectboard Meeting Room at the Brattleboro Municipal Center at 230 Main Street. The public may also participate in the meeting over Zoom. The attached agenda contains information on how to access the meeting remotely, including the required “passcode.”  ASL interpreters will be available for deaf and hard-of-hearing community members.

The Board is asked to recommend that the Vermont Department of Health reappoint Zoning Administrator Brian Bannon as an additional Deputy Health Officer for a three-year term.

In a memorandum dated September 23, 2022 Public Works Director Dan Tyler recommends that the Board award the FY23 winter sand bid to Northeast Paving for the “picked up” price of $13.25 per cubic yard.

In a memorandum dated September 23, 2022 Public Works Director Dan Tyler recommends that the Board authorize the replacement purchase of Utilities Division vehicle #101 from Brattleboro Ford of Brattleboro, VT, for $26,455 and the upfit costs by DPW of $1700, for a total of $28,145. The total budgeted amount for the replacement is $35,000. Rather than trade the current vehicle, DPW proposes that it be repurposed as a parking enforcement vehicle. The current parking enforcement vehicle will be repurposed or sold as surplus equipment.

In a memorandum dated October 3, 2022, Interim Town Manager Patrick Moreland requests that the Board accept and appropriate a Community Development Block Grant in the amount of $542,920. This grant is in support of a project intended to rehabilitate a now empty building and to construct a new mixed-use environment with office space on the first floor and 15 affordable housing units on the remaining three floors. The Grant agreement between the Vermont Community Development Program and the Town of Brattleboro has been reviewed and is recommended for your approval by staff and Town Attorney Bob Fisher.

In a memorandum dated September 27, 2022 Interim Town Manager Patrick Moreland outlines the schedule of budget meetings for the FY24 Budget.

POTENTIAL MOTION: TO ACCEPT THE CONSENT AGENDA, AS PRESENTED.

8. LIQUOR COMMISSIONERS

A. Epsilon Spires Entertainment License – Approve Application

In a memorandum dated September 13, 2022 Town Clerk Hilary Francis explains that Epsilon Spires would like to hold indoor and outdoor events at their 190 Main Street location. The events will take place between the hours of 9:00am and 12:00am, with an estimated 15-150 attendees. Town staff have reviewed and approved this permit request. This request is coming before the Board because it is an annual permit that is being sought at a non-liquor license renewal time of year. Jamie Mohr from Epsilon Spires will be present to address any issues the Board might have.

POSSIBLE MOTION: TO APPROVE AN ANNUAL ENTERTAINMENT LICENSE FOR EPSILON SPIRES LOCATED AT 190 MAIN STREET.

B. The Brattleboro Third Class Liquor License – Approve Application

In a memorandum dated September 21, 2022 Town Clerk Hilary Francis explains that The Brattleboro, an Inn located at 770 South Street, which holds a First Class Liquor License and Outdoor Consumption Permit, are now applying for a Third Class Liquor License. There was an error when applying for their First Class Liquor License and so their Third Class Liquor License was not approved at that time. Staff recommends approving this additional license. Chad Tinti will be present at the Selectboard meeting to address any concerns the Board might have.

POSSIBLE MOTION: TO APPROVE A THIRD-CLASS LIQUOR LICENSE FOR THE BRATTLEBORO LOCATED AT 770 SOUTH STREET.

9. NEW BUSINESS

A. SBAP Loan to W.R. Metalarts – Authorize $37,5000 Loan

In a memorandum dated September 22, 2022, Town Accountant Kim Ellison explains that the Small Business Assistant Program Loan Committee met on September 19, 2022 to review a loan application and recommend the approval of the following loan: W.R. Metalarts, LLC of $35,700 amortized over 7 years at 3% per annum with a monthly payment of $495.50. Security will be a UCC on a 3D printer and a personal guaranty from Will Nevins-Alderfer.

POSSIBLE MOTION: TO AUTHORIZE A LOAN FROM THE TOWN’S REVOLVING LOAN FUND TO W.R. METALARTS, LLC AS FOLLOWS: $37,500 AMORTIZED OVER 7 YEARS AT 3% PER ANNUM WITH A MONTHLY PAYMENT OF $495.50, WITH SECURITY IN THE FORM OF A UCC ON A 3D PRINTER AND A PERSONAL GUARANTY FROM WILL NEVINS-ALDERFER.

B. Resolution Recognizing Freedom Against Domestic Violence

Kelsey Rice & Shari In a memorandum dated September 6, 2022, The Women’s Freedom Center and Survivor Kelsey Rice discuss a proposed resolution recognizing freedom from domestic violence as a fundamental human right. Included in the Board’s backup materials is a report from Vermont Network discussing the economic impact of domestic and sexual violence in the state of Vermont. The Board is asked to discuss and possible adopt this resolution.

POSSIBLE MOTION: TO ADOPT THE RESOLUTION OF THE TOWN OF BRATTLEBORO RECOGNIZING FREEDOM FROM DOMESTIC VIOLENCE AS A FUNDAMENTAL HUMAN RIGHT.

C. Brattleboro Code of Ordinances Chapter 4, Proposed Changes – First Reading

In a memorandum dated September 21, 2022 Planning Director Sue Fillion discusses the proposed changes to Chapter 4 Bicycles, Article I General and Article II Operation of the Battleboro Code of Ordinances. Fillion explains that the ordinance has not been reviewed in roughly twenty years. Alice Charkes of the Traffic Safety Committee and Police Chief Norma Hardy have reviewed the proposed changes. The Board is asked to review the proposed changes and to provide possible feedback.

NO MOTION IS REQUIRED ON THIS ITEM.

D. Radio Replacement – Brattleboro Police Department

In a memorandum dated September 22, 2022, Police Chief Norma Hardy discusses the need for police radio replacement as soon as possible. Chief Hardy indicates that Motorola has said that the BPD’s current radios are at the end of their lives and can no longer be serviced and that the batteries in these radios have trouble holding a charge for longer periods of time. Chief Hardy discusses the importance of police radios to all officers and illustrates a recent example of a time when an officer had trouble contacting Dispatch during an emergency because their radio did not work. Chief Hardy indicates that radio replacement funds are a part of the FY26 Budget, but new radios are needed more urgently. Chief Hardy recommends ordering 19 radios. The total cost for 19 radios is $90.690.42 or $4773.18 per radio.

POSSIBLE MOTION: TO AUTHORIZE A PURCHASE IN THE AMOUNT OF $90,690.42 FOR 19 NEW APX 8000 RADIOS FOR THE BRATTLEBORO POLICE DEPARTMENT.

E. Pistol Replacement – Brattleboro Police Department

In a memorandum dated October 4, 2022 Police Chief Norma Hardy requests authorization to purchase new service pistols for the Brattleboro Police Department. She indicates that this purchase was slated in the Capital Budget two years ago, but the purchase was delayed. The current pistols are now 12 years old and showing signs of wear. She outlines a plan to transition the duty pistols from .40 caliber to lighter, less expensive 9mm pistols. Training through this transition should be minimal. Chief Hardy recommends the purchase of S&W 9mms and the streamlined attachments from Jurek Brothers and holsters from AAA Police Supply in Dedham, MA for a total cost of $23,706.78.

POSSIBLE MOTION: TO APPROVE THE PURCHASE OF S&W 99MM PISTOLS WITH STREAMLIGHT ATTACHMENTS FROM JUREK BROTHERS AND THE PURCHASE OF HOLSTERS FROM AAA POLICE SUPPLY IN DEDHAM, MA FOR THE BRATTLEBORO POLICE DEPARTMENT FOR A TOTAL OF $23,706.78.

F. Announce Committee Vacancies

The Board is asked to announce vacancies to various Town Boards and Committees. Because the next Selectboard meeting is only one week away, the Board plans to begin making committee appointments at the November 1, 2022 meeting to give the public time to submit thoughtful applications.
