Brattleboro Selectboard Agenda and Notes – June 7, 2022

The Brattleboro Selectboard will emerge from another Executive Session to do something that isn’t done very often – update the boundaries of the voting districts in town, which will change representation at Representative Town meeting. This update is to conform with adjustments recently made by the state.

The board will also take up the Utility Fund, Parking Fund Budget, raises, and the Depot Street parking lot project. You can bring up other items not on the agenda during public participation.

The Brattleboro Selectboard will meet on Tuesday, June 7 , 2022, at 5:30pm and is expected to enter immediately into Executive Session to discuss contracts, labor relations agreements with employees and the appointment or employment or evaluation of a public officer or employee . The Selectboard will reconvene the business part of the meeting at 6:15pm in the Selectboard Meeting Room at the Brattleboro Municipal Center at 230 Main Street. Everyone will be required to  maintain social distance. The public is encouraged to participate in the meeting over Zoom. The attached agenda contains information on how to access the meeting remotely, including the required “passcode.”  ASL interpreters will be available for deaf and hard-of-hearing community members.

In a memorandum dated May 20, 2022 Town Accountant Kim Ellison requests that the Selectboard approve the Police Department’s application for a $14, 836.50 Patrick Leahy Bulletproof Vest Grant from the Bureau of Justice Assistance to pay for 20 bulletproof vests.

In a memorandum dated June 1, 2022 Planning Director Sue Fillion requests that the Selectboard approve the application of a VTrans Small Scale Bicycle and Pedestrian Grant in the amount of $35,500 to help pay for construction of 5foot bicycle lanes on the eastern and western sides of Western Avenue from Green Street to Highlawn. This construction will also include two new crosswalks at Speno Court and Green Street, bike lane signage, and a Rapid Rectangular Flashing Beacon at Allerton Street. The Town will be responsible for a $17,750 local match. $12,000 was transferred into the Capital Fund from the FY23 budget. The remaining match will come from inkind labor by Public Works staff.

In a memorandum dated May 27, 2022 Planning Director Sue Fillion discuses the Whetstone Brook Floodplain Restoration project. The total project cost is estimated to be $1,113,472.93 with 75% of the cost ($835,104.70) coming from a FEMA Hazard Mitigation Grant. The remaining 25% of the cost will be funded by the Vermont Emergency Management Flood Resilient Communities Fund. Fillion requests authorization to apply for a Vermont Emergency Management State of Vermont Hazard Mitigation Program Grant of up to $835,104.70 to restore the natural floodplain function at 250 Birge Street.

The Selectboard is asked to approve the annual dog warrant to enforce the requirement that all dogs in the Town of Brattleboro be vaccinated and licensed. The required statutory language is in the warrant, including reference to humane destruction of animals that have not been licensed by their owners. However, the Town has never exercised that authority and has no intention of exercising that authority in the enforcement of the 2022 licensesThe list of currently unlicensed dogs is included in the Selectboard’s notebooks for this meeting. Since payments and documentation are still being received by the Town Clerk’s Office, staff will provide an uptotheminute list on the day of the meeting. By approving this item on the Consent Agenda, the Board will approve the annual dog warrant in the form that is accurate as of 4pm on June 7, 2022.

8. HEALTH COMMISSIONERS

A. Reappoint Deputy Health Officers Chris Fellows & Matt Casabona

The Board is asked to recommend that the Vermont Department of Health reappoint Chris Fellows and Matt Casabona as Deputy Health Officers for a threeyear term ending in June of 2025, per the memorandum from Assistant Fire Chief Charles Keir.

POTENTIAL MOTION: TO RECOMMEND THAT THE VERMONT DEPARTMENT OF HEALTH REAPPOINT CHRIS FELLOWS AND MATT CASABONA AS DEPUTY HEALTH OFFICER FOR A THREEYEAR TERM ENDING IN JUNE OF 2025

9. LIQUOR COMMISSIONERS

A. Winston Prouty Par for the Cause Festival Permit

The Board is asked to approve a festival permit for Winston Prouty Center for Child and Family Development’s annual “Par for the Cause” Festival. Staff has reviewed the application and recommends approval. Willie Gussin will attend the meeting to describe the event and answer questions.


POTENTIAL MOTION: TO APPROVE A FESTIVAL PERMIT FOR THE WINSTON 
PROUTY CENTER FOR CHILD AND FAMILY DEVELOPMENT TO HOLD ITS ANNUAL “PAR FOR THE CAUSE” EVENT ON JUNE 25, 2022, WITH THE EFFECTIVE DATES OF THE PERMIT TO BE JUNE 24 25, 2022.


10. NEW BUSINESS

A. Representative Town Meeting District Certification

In a memorandum dated May 25, 2022, Town Clerk Hilary Francis explains that pursuant to the Town Charter, in any year in which Representative Town Meeting Districts are revised, the Selectboard shall certify to the Town Clerk the total number of voters in each district and the total number of Town Meeting members each district is entitled to. The Board of Civil Authority noted on May 20, 2022 to accept the new Town Meeting Member District Boundaries to conform to Brattleboro’s three legislative districts that were adjusted this winter by the Vermont Legislature as part of the Statewide reapportionment.

POTENTIAL MOTION: TO CERTIFY TO THE TOWN CLERK THE TOTAL NUMBER OF VOTERS IN EACH DISTRICT AND THE TOTAL NUMBER OF TOWN MEETING MEMBERS EACH DISTRICT IS ENTITLED TO ELECT.

B. Annual Utility Fund Budget & Capital Plan Approval

In a memorandum dated June 2, 2022, Interim Town Manager presents the proposed FY23 Utility Fund Budget, along with a Utility Fund cash reconciliation. In addition, Public Works Director Dan Tyler summarizes the proposed FY23 Utilities Capital Plan. Moreland, Tyler and newly hired Finance Director Kim Frost will be present to walk the Board and the public through the budget, the cash reconciliation and the capital plan.

NO ACTION IS REQUIRED ON THIS ITEM.

C. Annual Parking Fund Budget & Capital Request Approval

In a memorandum dated June 2, 2022, Interim Town Manager Patrick Moreland presentthe proposed FY23 Parking Fund Budget for Selectboard consideration.

D. FY23 Salary Increase for NonUnion Employees

In a memorandum dated June 2, 2022, Interim Town Manager Patrick Moreland recommended that the Selectboard authorize a 3% salary adjustment for all nonunion Town employees, effective on July 1, 2022.

POTENTIAL MOTION: TO APPROVE THE 3% PAY INCREASE FOR FY23 FOR ALL TOWN NONUNION EMPLOYEES.

E. Depot Street Parking Lot

(i) Award Construction Bid

(iii) Transfer to Capital Fund

In a memorandum dated June 2, 2022, Interim Town Manager Patrick Moreland discusses the historical background, project background, and project finances regarding the Depot Street Parking Lot project. With a transfer of $99,250 from the General Fund to the Capital Fund, the Town will be able to complete this project and begin construction just before Amtrakgets underway with their new train station. The Board is asked to award the construction bid for the Depot Street Parking Lot project to Bernie LaRock and Son’s, Inc, of Guilford, VT award the Qualified Environmental Professional Oversight contract to Stone Environmental of Montpelier, VT and to transfer the sum of $99,250 from the General fund to the Capital fund to help finance this project.

POTENTIAL MOTION: TO AWARD A BID IN THE AMOUNT OF $365,050 TO BERNIE LAROCK AND SON, INC OF GUILFORD, VERMONT FOR THE RECONSTRUCTION OF THE DEPOT STREET PARKING LOT.

POTENTIAL MOTION: TO AWARD A CONTRACT TO STONE ENVIRONMENTAL OF MONTPELIER, VERMONT FOR QUALIFIED ENVIRONMENTAL PROFESSIONAL OVERSIGHT OF THE DEPOT STREET PARKING LOT PROJECT AND TO PRODUCE A CORRECTIVE ACTION CONSTRUCTION COMPLETION REPORT.

POTENTIAL MOTION: TO AUTHORIZE A TRANSFER OF $99,250 FROM THE GENERAL FUND TO THE CAPITAL FUND.

F. Announce Committee Vacancies

Most Town boards and committees have staggered terms with some members’ terms expiring on June 30 of each year. Thus, every June, the Board announces vacancies on virtually every Town board and committee. To fill current and upcoming vacancies, the Board will be asked to make appointments and reappointments at the June 21, 2022 Selectboard meeting.
