Golden Cross is back on the agenda with a limited-time offer that will only cost $50,000 a year after the initial 90 day free trial. The Brattleboro Selectboard will, by approving this, “expand the second AEMT provider to 24 hours per day and situate a third ambulance (to be housed at Station 2.)”
They will also discuss liquor licenses, fines for rental housing inspection program violations, Waste Water Treatment Plant and water pump improvements, and more. You can bring up other issues not on the agenda during public participation.

In a memorandum dated June, 2022, Executive Assistant Jessica Sticklor explains that municipalities are now required to certify the appointment of the Tree Warden and provide contact information to the commissioner of Forests, Parks & Recreation. Dan Adams, who has been the Town’s Tree Warden for approximately twenty-six years, has confirmed that he would like to be re-appointed as Tree Warden for another year. By approving this item on the Consent Agenda, the Board will re-appoint Dan Adams as the Brattleboro Tree Warden for a one-year term
In a memorandum dated June 1, 2022 Fire Chief Leonard Howard explains that the $45,000 purchase of a new Car 1 was approved at the 2019 RTM for the Capital Equipment Budget for FY23. The current Car 1 is a 2013 Ford Explorer. The price of a new Car 1 is $42,570. The Fire Department are trading in a 2011 Ford Explorer (with a $5000 trade-in allowance). The current Car 1 will become a staff vehicle for our part-time fire inspector. It will cost an addition $8,479 to upfit the vehicle for a total of $46,348 to purchase the vehicle. This will be $1,348 over budget; a sum which can be absorbed by the Capital Fund balance.
In a memorandum dated June 10, 2022, Public Works Director Dan Tyler explains that the 2022 Summer Paving Contract was awarded to All States Construction for $358,471.75. Included in this project was the lower portion of Cotton Mill Hill. The remainder portion of Cotton Mill Hill was left out of the bid because DPW was uncertain where bids would come in. The bids were favorable and upon further review DPW finds that it would make the most sense to pave the entire road. All States Construction is willing to complete this project at an increased cost of $57,800. The total cost of the project would be $416,271.75. By approving the consent agenda, the Board would be approving an increase of $57,800 to the Summer Paving Bid.

8. LIQUOR COMMISSIONERS
A. Kipling’s Tavern – 1st class and 3rd class liquor license
Kipling’s Tavern and Pub, located at 78 Elliot Street, is in the process of being purchased and will be called Kipling’s Tavern. They are planning to open in mid to late-July and are applying for a First-Class and Third-Class Liquor License. Mr. Gelke will be present at the Selectboard meeting to answer any questions the Board might have.
POTENTIAL MOTION: TO APPROVE A FIRST-CLASS AND A THIRD-CLASS LIQUOR LICENSE FOR KIPLING’S TAVERN LOCATED AT 78 ELLIOT STREET.
B. Retreat Farm – Outside Consumption Permit
Retreat Farm, located at 45 Farmhouse Square, applied for a First-Class Liquor License in 2021, which was approved by the Selectboard and has been with the Department of Liquor Control. The DLC is ready to approve that license. The Retreat Farm is now applying for an Outside Consumption Permit to accompany their soon-to-be-acquired First-Class Liquor License. Ms. Crowell will be present at the Selectboard meeting to answer any questions the Board might have.
POTENTIAL MOTION: TO APPROVE AN OUTSIDE CONSUMPTION PERMIT TO RETREAT FARM LOCATED AT 45 FARMHOUSE SQUARE.
C. High Thai – 3rd class liquor license
High Thai, located at 7 High Street, currently holds a First-Class Liquor License that was approved by the Selectboard earlier this year. They are now seeking a Third-Class Liquor License. Mr. Drone will be present at the Selectboard Meeting to address any questions the Board might have.
POTENTIAL MOTION: TO APPROVE A THIRD-CLASS LIQUOR LICENSE TO HIGH THAI LOCATED AT 7 HIGH STREET.
D. Vegan and Flex LLC– 1st class liquor license and Outside Consumption Permit Vegan and Flex LLC recently purchased the building at 105 Canal Street. They are planning to serve vegan food, beer and wine for lunch and dinner on Thursdays, Fridays and Saturdays, with brunch on Sundays. They plan to open as soon as they obtain a First Class Liquor License and an Outside Consumption permit. Ms. Peruzzi and Ms. Gwinn, co- owners of the restaurant, will be present at the Selectboard meeting to answer any questions the Board might have.
POTENTIAL MOTION: TO APPROVE A FIRST-CLASS LIQUOR LICENSE AND AN OUTSIDE CONSUMPTION PERMIT TO VEGAN AND FLEX LLC LOCATED AT 105 CANAL STREET.
9. WATER AND SEWER COMMISSIONERS
A. WWTP Fire Alarm – Authorize Purchase
In a memorandum dated June 9, 2022, Public Works Director Dan Tyler explains that Johnson Controls Fire Protection LP recently performed an inspection of the fire alarm system at the wastewater treatment plant. Faults with the existing fire alarm panel cannot be rectified because the panel and repair parts are obsolete. Johnson Controls provided a quote of $14,894.65 to furnish and install a new panel. The quote exceeds the limit of procurement policy without a formal bid process; however, Johnson Controls has been the sole contractor to work on this system. DPW consulted with a local electrician/alarm contractor, and they recommend accepting the quote from Johnson Controls because of the proprietary equipment that they would need to source from them directly.
POTENTIAL MOTION: TO AUTHORIZE AN EXPENDITURE IN THE AMOUNT OF $14,894.64 WITH JOHNSON CONTROLS FIRE PROTECTION LP TO FURNISH AND INSTALL A NEW FIRE ALARM PANEL AT THE WASTEWATER TREATMENT PLANT.
B. Signal Hill Electric Upgrade – Authorize Purchase
In a memorandum dated June 9, 2022 Public Works Director Dan Tyler explains that the State of Vermont completed a sanitary survey of the water pumping station at Signal Hill and noted the need to upgrade the station to meet the current water supply needs. Design of the Signal Hill Pump Station is complete and DPW is preparing to advertise the project later this summer. The new pump station will require the installation of a new 3-phase electrical service. Our design consultant, Dufrene Group, has recommended that the Town contract with Green Mountain Power. DPW received a quote from Green Mountain Power of $22,003.24 to extend and install the 3-phase service. Capital funds for the reconstruction of the pump will be used to cover the expense.
POTENTIAL MOTION: TO ACCEPT THE QUOTE OF $22,003.24 FROM GREEN MOUNTAIN POWER TO EXTEND AND INSTALL A NEW 3-PHASE ELECTRICAL SERVICE AT THE SIGNAL HILL PUMP STATION.

B. EMS Contract – Amend Agreement with Golden Cross
In a memorandum dated June 16, 2022 Interim Town Manager Patrick Moreland explains that after further discussions with Golden Cross, Golden Cross has offered a limited 90-day
period to expand the second AEMT provider to 24 hours per day and situate a third ambulance (to be housed at Station 2) at no additional cost. After the 90-day period, the Town can choose to return to the normal level of service or we can increase the level of service to include these new assets for an additional annual cost of $50,000. The Board is asked to authorize the Interim Town Manager to execute contract Addendum A with Colden Cross Ambulance Service, INC.

C. VCDP Closeout Public Hearing – Tri-Park
In a memorandum dated June 14, 2022, Planning Department Director Sue Fillion discusses some of the details of and the history of the Tri-Park Master Plan, which was completed in 2020. The Board is asked to conduct a close out public hearing for the Tri- Park Master Plan Project, funded in part by a Community Development Block Grant.

D. Ordinance Amendment Chapter 8 – First Reading
In a memorandum dated June 13, 2022 Interim Town Manager Patrick Moreland discusses an amendment to the Brattleboro Code of Ordinances, Chapter 8, Health, Sanitation, Fire Safety Inspections and Rental Housing, Section 8-55 Penalty and Enforcement and Section 8-55.1, Schedule of Fines. In 2019 the Selectboard added Article 4 to Chapter 8 of the Brattleboro Code of Ordinances, however a Schedule of Fines was planned but never completed, as the pandemic emerged not long after the Article was added. Staff is now bringing forward this amendment to finalize this important component of the Rental Housing Inspection Program.

ADDENDUM A
TOWN OF BRATTLEBORO
AMBULANCE SERVICE CONTRACT
July 1, 2022-June 20, 2023
This is Addendum A to the Agreement made by and between the Town of Brattleboro, a municipal corporation, with an address of 230 Main Street, Brattleboro, Vermont, 05301 (hereinafter the “Town”) and Golden Cross Ambulance Service Inc., a New Hampshire corporation with a principal place of business at 5 Lincoln Heights, Claremont, New Hampshire, 03743 (hereinafter “Golden Cross”), said original Agreement dated April ____, 2022.
WHEREAS, the Parties have further discussed the staffing requirements for the ambulance services for the Town of Brattleboro, and in consideration of mutual promises hereinafter recited, the Parties make this first amendment to the Agreement.
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto agree as follows:
AMENDMENT TO DESCRIPTION OF SERVICES
In addition to the services and terms set forth in the original Agreement, Golden Cross agrees to provide to the Town of Brattleboro a third ambulance and one 24-hour AEMT, instead of a 12-hour EMT, at no additional charge for the first 90 days of the Contract.
This Agreement shall be governed by the laws of the State of Vermont.

“Selectboard,
I wanted to articulate some of how we will respond to medical emergencies and reference when the Town of Brattleboro would request mutual aid. Each day the Brattleboro Fire Department has a minimum of six (6) personnel on duty at any given time. During normal office hours, Brattleboro Fire Department has nine (9) personnel capable of responding. Moving past July 1, 2021, we will have two (2) additional staff members capable of responding to medical emergencies from Golden Cross. If the Board approves the contract addendum with Golden Cross, the second provider is going to be 24/7 for the first 3 months. This will help us judge if that provider is needed 24/7 and if not get a better idea of the hours the second provider can be best utilized.
After July 1, 2022, the Brattleboro Fire Department has ten (10) response vehicles and three (3) ambulances capable of responding to emergencies. In 2021 we responded to 2656 emergencies and expect to respond to 3669 emergencies for the fiscal year 2022/2023.
It is very common for the Town of Brattleboro to give and receive mutual aid for all emergencies that occur in the surrounding communities and Brattleboro. In 2021 The Town of Brattleboro provided mutual aid 106 times to the surrounding communities. This does not mean we provided a backup service to those communities. They had exhausted their own and requested assistance in mitigating an emergency/emergency in those communities.
With the partnership of the Town of Brattleboro and Golden Cross. The Brattleboro Fire Department will not require a backup service to protect to people of Brattleboro. During large-scale events and times of extreme call volume, it may be necessary to work with mutual aid partners to ensure adequate coverage within the Town of Brattleboro. These times are as follows: multi-alarm fires, mass casualty events, and large public gatherings, to indicate a few.
When the need for emergency medical service (EMS) mutual aid occurs in Brattleboro, will request from the following agencies in this order: Keene Fire Department, Diluzio Ambulance (Keene NH), Greenfield Fire Department, Deerfield Valley Ambulance, Swanzey Ambulance, Golden Cross Ambulance (of Westminster VT), Winchester Ambulance Service, Turners Falls Ambulance, Springfield VT Ambulance.
