Brattleboro Selectboard Agenda and Notes – January 4, 2022

The first regular meeting of the Brattleboro Selectboard in 2022 is also the start of Yoshi Manale’s tenure as Town Manager. Welcome, Yoshi!

Changes to the Agricultural Land Preservation Fund will be discussed. The board will also consider feeding and providing childcare for Representative Town Meeting, they’ll review goals, and consider some traffic safety items. And, as always, you can bring up other items not on the agenda during public participation.

The Brattleboro Selectboard will meet on Tuesday, January 4, 2022, at 6:15pm in the Second Floor Meeting Room at the Central Fire Station (103 Elliot Street). Everyone will be required to wear a face covering and maintain social distance. The public is encouraged to participate in the meeting over Zoom. The attached agenda contains information on how to access the meeting remotely, including the required “passcode.”  ASL interpreters will be available for deaf and hard-of-hearing community members.

7. CONSENT AGENDA 

A. Development Agreement with Brattleboro Housing Partnerships re: Melrose Terrace – Approve 

In a memorandum dated December 27, 2021, Planning Director Sue Fillion requests that the Selectboard approve the draft Development Agreement between the Town and the Brattleboro Housing Authority to realign the roadway serving Melrose Terrace as well as realign the storm water, water and sewer lines associated with the area. The agreement was drafted by Town Attorney Bob Fisher and has been reviewed by the Public Works Department. By approving the consent agenda, the Selectboard will authorize Town Manager Yoshi Manale to execute the Development Agreement between the Town and Brattleboro Housing Authority.

B. Better Back Roads Grant – Ratify Town Manager’s Decision to Authorize Application 

In a memorandum dated December 16, 2021, Public Works Director Dan Tyler requests that the Selectboard ratify the Town Manager’s decision to approve the Public Works Department’s application for a $78, 437.68 FY2023 Better Back Roads Grant from the Vermont Department of Transportation to pay for the implementation of best management practices on hydrologically connected road segments in compliance with DEC Municipal Roads General Permit. Three separate projects in three grant categories were applied for. The match would be funded through the Public Works general fund budget. The projects include erosion control and stormwater mitigation on Sunset Lake Road, correction of stream/culvert erosion on Abbot Road, and replacement of an undersized and aging box culvert/bridge on Akley Road. By approving the consent agenda, the Selectboard will authorize the application for a $78, 437.68 FY2023 Better Back Roads Grant from the Vermont Department of Transportation.

A. Review Status of 2021-2022 Selectboard Goals 

NO ACTION REQUIRED FOR THIS ITEM. 

B. Further Consideration of RTM Steering Committee Recommendations & Requests 

In a memorandum dated November 30, 2021, Millicent Cooley, Chair of the Representative Town Meeting Steering Committee, outlines the committee’s request to place a separate article on the 2022 Representative Town Meeting Warning and to include $2,500 in the FY2023 budget for lunch for all Representative Town Meeting members in March of 2023. The Committee also requests similar funding, not included in the FY22 budget, for lunch at the 2022 Representative Town Meeting. Lunch will be supplied by Brattleboro Union High School students, who support this initiative. 

POTENTIAL MOTION: TO PLACE AN ARTICLE ON THE 2022 REPRESENTATIVE TOWN MEETING WARNING AND TO INCLUDE THE SUM OF $2,500 IN THE FY23 BUDGET TO PAY FOR LUNCH ON DAY ONE OF REPRESENTATIVE TOWN MEETING IN MARCH OF 2023. 

C. Further Consideration of the FY23 General Fund Budget Unfinished Matters 

The Board will discuss unfinished matters pertaining to the FY23 General Fund Budget. 

NO ACTION REQUIRED FOR THIS ITEM. 

9. NEW BUSINESS 

A. Agricultural Advisory Committee Recommendation for Agricultural Land Protection Fund 

In a memorandum dated December 10, 2021, Planning Director Sue Fillion discusses the history of the Agricultural Land Protection Fund and the recommendations from the Agricultural Advisory Committee for modernizing the Fund. These recommendations include re-conceptualizing this revolving loan fund by making the fund available for a wider array of food system-related expenses to allow parts of the loan provided to later be forgiven, depending on the fund’s performance and nature of the loan applicant. The Agricultural Advisory Committee asks the Board to put an article on the Representative Town Meeting warning to expand the Agricultural Land Protection Fund to include providing loans, working capital and business management, in addition to purchasing real property rights in order to protect agricultural lands in Brattleboro. They would also like the name of the fund to be changed to the Brattleboro and Food Systems Revolving Loan and Grant Fund. 

POTENTIAL MOTION: TO PLACE AN ARTICLE ON THE WARNING TO EXPAND THE AGRICULTURAL LAND PROTECTION FUND TO INCLUDE PROVIDING LOANS, WORKING CAPITAL AND BUSINESS MANAGEMENT IN ADDITION TO PURCHASING REAL PROPERTY RIGHTS IN ORDER TO PROTECT AGRICULTURAL LANDS IN BRATTLEBORO AND TO RENAME THE FUND THE BRATTLEBORO FOOD AND SYSTEMS REVOLVING LOAN AND GRANT FUND. 

B. Childcare for Representative Town Meeting – 

Chloe Learey, the Executive Director of the Winston Prouty Center for Child+Family Development will join the meeting to discuss childcare options for Representative Town Meeting. 

NO ACTION REQUITED AT THIS TIME. 

C. Safety Improvements at the Intersection of Canal Street + South Main Street and on Oak Street – First Reading of Ordinance 

In a memorandum dated December 28, 2021, Assistant Town Manager Patrick Moreland discusses recommended changes to the Brattleboro Code of Ordinances including adding a stop sign at Canal Street at South Main Street and to limit parking on the westerly side of Oak Street, in the area directly in front of 24 Oak Street, the Community School Monday through Friday from 7:15am – 8:30am and from 2:15pm to 3:30pm. The Selectboard is asked to conduct a First Reading to the Brattleboro Code of Ordinances, Appendix C, Section 16-70, Stop signs, Add Canal at South Main and to Appendix C, Section 16 – 101, Limited Parking, Add Oak Street in front of Community House School.
